The COVID-19 pandemic has created many new issues for employers. One of the biggest changes that has occurred is remote working. This creates potential state income tax issues for employees and employers.
For instance, which state or states should the employer be withholding employee taxes on? Does having an employee in another state create state income tax nexus for employers, potentially requiring the company to file a state income tax return in the state? Will Congress be able to fix this issue with legislation?
Overall, there are still various unanswered questions, but it is of the utmost importance that companies stay abreast of any tax vulnerability that employers and/or remote employees may endure.
